Terms of Use

By using Nivelo, you agree to these terms. If you don't agree, don't use the service. If you use Nivelo on behalf of an organization, you have authority to bind that organization to these terms.

Nivelo is a CEFR (Common European Framework of Reference) language proficiency assessment service. We offer: a free 5-minute test, a paid 30-minute test ($4.99), and an optional Pro subscription ($9.99/month or $99/year), with a free trial.

Nivelo is NOT an official certification. We are not affiliated with the Council of Europe, Instituto Cervantes, Cambridge English, or any official certification body. For official certificates, see DELE or Cambridge.

• You must provide accurate information and keep it current.
• You're responsible for your account's security (Nivelo uses magic-link sign-in — protect access to your email).
• You must be at least 13 years old to use Nivelo. If you're between 13 and 18, you must have parental/guardian permission.

• 30-min test ($4.99): Refundable within 7 days if not started. Once started, no refund — but we'll grant a free retake within 30 days if you feel the result was off.
• Pro subscription: Includes a free trial; you aren't charged until it ends. Full refund within 7 days of the first charge. Cancelable any time — you keep access through the end of the period paid.
• Auto-renewal: Subscriptions renew automatically at the then-current price at the start of each period (monthly or annual) until you cancel. We charge the payment method on file. You can cancel any time before renewal from your account settings; cancellation takes effect at the end of the current period.
• Payments are processed by Stripe. Their terms apply too.
• Standard prices may change with at least 30 days' notice. Founding members keep their rate locked for as long as their subscription stays active.

You must not:

• Reverse engineer, decompile, or attempt to extract our question bank.
• Use automated access (scraping, bots) without written permission.
• Resell our content or tests to third parties.
• Impersonate another person or misrepresent your results.

We may suspend or close accounts that violate these terms.

The question bank, reading passages, generated reports, design, code, and all content on Nivelo are owned by Nivelo (or licensed to Nivelo). You receive a personal, non-transferable, non-exclusive license to use Nivelo under these terms.

Your responses, writing, audio recordings, and saved vocabulary remain yours. You grant us a limited license to process them to provide the service (grading, feedback generation, storage). We don't sell your content. We don't use it to train public AI.

Nivelo is provided "as is". We don't guarantee the service will be error-free, uninterrupted, or that your computed CEFR level will exactly match an official exam result. AI grading is a best-estimate against CEFR descriptors; it's not infallible.

To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages. Our total liability under these terms shall not exceed the amount you paid Nivelo in the past 12 months.

These terms are governed by the laws of Washington State, United States. Disputes shall be resolved in state or federal courts in King County, Washington.

Before starting any formal action, you agree to contact us at help@getnivelo.com to try to resolve the dispute informally for at least 30 days. Any claim is brought on an individual basis — not as part of a class or representative action — to the extent permitted by law.

We may update these terms. We'll notify you by email of material changes at least 30 days before they take effect.
